Individual tenancy agreements (one contract per person)

 

WHAT AN INDIVIDUAL TENANCY MEANS


If you have an individual tenancy agreement, you are only legally responsible for your own rent and your own obligations. Your tenancy is separate from anyone else living in the property.

This means:
  • Your rent, notice, and responsibilities are not linked to other tenants
  • Problems caused by other tenants usually do not affect your tenancy
  • You normally deal with the landlord or agent only about your own agreement.


ENDING THE TENANCY


If your tenancy is periodic (which all assured tenancies will be from 1 May 2026), you can usually end it by giving at least 2 months' notice, with the notice ending at the end of a rent period.

If you are still in a fixed-term tenancy (for example, before May 2026), you usually cannot leave early unless:
  • your contract includes a break clause, or
  • the landlord agrees to an early surrender.

Because notice rights depend on both the type of tenancy and the timing, it's important to check:
  • whether your tenancy is fixed-term or periodic, and
  • what your written agreement says.


DEPOSITS AND CONDITION


You are responsible for the condition of your own room or unit. Deductions from your deposit should relate only to your tenancy, not to shared areas (unless your contract says otherwise).

 If you're unsure as to how or when you can leave, getting advice before serving notice can help to avoid rent liability continuing after you move out.

Make sure that you check:

What space your contract covers: Individual contracts often cover a specific room, with shared access to kitchens or bathrooms.

Notice rules still apply: You usually need to give proper notice.
